1. Introduction
The objective of the scheme is to provide refinance assistance to Regional Rural Banks (RRBs) in respect of the individual housing loans already advanced by them for purchase/construction/ repairs & upgradation of housing unit.
2. Eligibility Criteria and Extent of Refinance
Regional Rural Banks (RRBs) having positive net owned fund * fulfilling the following criteria will be eligible to draw refinance from NHB as shown below :
Net NPA to net advances ratio less than or equal to 5% and making profit as per the latest audited accounts would be eligible for refinance to the extent of 100%
Net NPA to net advances ratio not exceeding 7.5% and making profit as per the latest audited accounts or making losses as per the latest audited accounts but showing promising signs of improvement towards profitability would be eligible for refinance to the extent of 50%

3. Eligible loans
Direct Housing loans upto Rs. 15 lakhs disbursed by the RRBs to individuals would be eligible for refinance from NHB. All housing loans covered/to be covered under refinance should be Standard Assets in terms of RBI guidelines applicable to RRBs.
4. Exposure Norm
Refinance exposure to RRBs would be restricted to 5 times of NOF of the RRB or 10% of NHB's capital fund whichever is less.
5. Rate of Interest
The interest rate charged to the RRBs shall be as prevailing on the date of disbursement and will depend on the repayment period opted by the RRB. The rate of interest is subject to periodic revision by NHB.
6. Revision in interest rate on fixed rate loans
For refinance outstanding at fixed rates of interest, NHB will have the option to revise the rates on outstanding loans on completion of 3 years. The revised rate will be effective from the quarter immediately following the quarter in which 3 years get completed. The applicable interest rate will be the then prevailing fixed rate of interest for the term equivalent to the original repayment period of that loan. In the case of upward revision, the RRB will have the option to either continue with the outstanding balance on the revised rates or to prepay the same without any prepayment levy. However, in the case of downward revision, if the RRB so desires, they would be allowed to prepay the amount only on payments of applicable prepayment levy.
7. Term of Refinance
The refinance will be repayable within a period not exceeding 10 years with a minimum repayment period of one year. The RRB will have the option to choose repayment period as per their requirement within the prescribed limit. Repayment of principal and payment of interest will be on quarterly basis. Repayment of principal will start after one clear calendar quarter from the date of release while payment of interest will start from the immediate quarter.
8. Prepayment
The RRB, after availing of refinance from NHB, may repay the whole or any part of the amount earlier than the due date by giving two months' notice to NHB of its intention to effect such repayment before the due date. NHB will levy a prepayment charge as mentioned below, on such prepayments:

The prepayment levy payable by RRBs to NHB would be independent of the fact as to whether prepayment levy is being charged by RRBs from their borrowers. The RRB will be required to furnish the particular refinance account numbers against which prepayment is being made. In the absence of such details the prepaid amount will be credited to the refinance released earliest and outstanding on ‘first in first out' basis. In case of part-prepayment, the size of instalment as originally fixed at the time of release will not be altered. Consequently, either the last instalment will get reduced or the period of repayment would get reduced depending on the amount prepaid.
9. Refinance Limit Sanction Procedure
The refinance operations of NHB are centralised at New Delhi . Refinance in a year will be released on the basis of the limit sanctioned to the RRB for the year [July to June]. RRB desirous of availing refinance will submit to NHB an application for sanction of refinance limit in the form NHB-ROD[RRB]-01 along with the following :
Annual Report of the RRB for the last three years.
Housing loans disbursements in the form NHB-ROD[RRB]-02 indicating the disbursement of housing loans during the previous year and outstanding housing loan
Classification of housing loans as on 31 st March of the last audited year in the form NHB-ROD[RRB]-03 .
A copy of the Executive summary of NABARD's latest inspection report / findings on the RRB, together with the compliance report thereon.
Board resolution designating the officials authorised to sign documents, claims, etc. for the purpose of the Refinance in format NHB-ROD[RRB]-04(A)/ NHB-ROD[RRB]-04(B) .

10. Documentation
RRBs availing refinance are required to execute a one time Memorandum of Agreement with NHB. They are also be required to execute a letter of authority in format NHB-ROD[RRB]-05 to its parent bank authorizing the parent bank to debit any monies lying in the account maintained with the parent bank in the event of default committed by the RRB in repayment of its dues to NHB and remit the same to NHB as and when requested by NHB.
11. Refinance Claims Procedure
After receiving sanction from NHB and on completion of all formalities as indicated in the sanction letter, the RRB has to submit an application to draw refinance in the form NHB-ROD[RRB]-06 to NHB at its New Delhi office. An official authorised for the purpose should sign the refinance applications submitted by RRB. The minimum size of a refinance application shall be Rs. 1 crore or the refinance limit whichever is lower.
12. Repayment Procedure
a] Repayments of principal and payments of interest / penal interest should be made at the Mumbai office of NHB, at 3rd floor, Bombay Life Building, 45, Veer Nariman Road, Fort, Mumbai 400 023.
b] Repayment of principal shall be made as indicated below:
i] The amount of refinance availed shall be repaid to NHB in a period not exceeding 10 years by way of 40 equal quarterly instalments or less, as may be specified by NHB.
ii] The due date for the repayments shall be the first day of each quarter [i.e. January 1, April 1, July 1 and October 1 each year].
iii] Repayment of principal shall commence after a gap of one clear calendar quarter following the disbursal of refinance and as may be specified by NHB. For example, if refinance is disbursed on October 4, 2002 the first instalment of principal will fall due for repayment on April 1, 2003, i.e. after a gap of calendar quarter January to March, 2003.
c] Payment of interest shall be made as indicated below :
i] Interest to be paid to NHB on refinance, will be calculated on daily product basis and charged at quarterly rests.
ii] For calculation of interest, a ‘year' will be taken as 365 days, irrespective of whether the year is a leap year or a normal year.
iii] Payment of interest shall commence from the first day of the quarter immediately succeeding the date of disbursal of refinance.
For example, if refinance is disbursed on October 4, 1997 interest on the refinance will first fall due for payment on January 1, 1998.
d] If the due date for repayment of principal / payment of interest is a holiday for the Mumbai office of NHB, and the credit in respect of the amounts due is received by NHB within the first three working days thereafter, the RRB shall pay interest on the amounts due, at the applicable rates of interest for the additional days upto the day of payment to the Mumbai office of NHB. It may please be noted in this regard, that the Mumbai office of the NHB observes holidays as declared for the State of Maharashtra in terms of the Negotiable Instruments Act, 1949. It may be noted, further, that NHB observes a five day week and that, accordingly, its offices remain closed on Saturdays and Sundays.
e] For any delay beyond the first three working days for the Mumbai office of NHB, the RRB shall pay additional interest on the amount in default for the total period of delay, at the rate of two per cent per annum above [i] the prevailing rate of refinance for the highest interest rate bracket for refinance in respect of such loans OR [ii] the applicable rate, whichever is higher.
f] RRB shall make payments to NHB promptly on due dates, irrespective of whether or not the amount is actually recovered by the RRB.
Other Terms:
Proper Books
Proper books of accounts, registers, etc. should be maintained by the RRB in respect of housing loans granted / refinance availed from NHB and these should be kept up-to-date.
Returns
NHB may call for any information or returns from the RRB availing refinance.
Statutory Returns
The RRB should be prompt and regular in submission of statutory returns.
Inspection / Audit Compliance
Action on any findings by inspection / audit of RBI / NABARD should be taken promptly.
Appraisal and Follow-up of Housing Loans
The RRB should have proper systems and procedures for appraisal and follow-up of housing loans, as also expert, qualified staff for handling housing loans and adequate arrangements for training them.
NHB's Guidelines
Finance provided by the RRB for housing and covered under the Scheme should conform to guidelines issued by NHB from time to time.
Obtaining Requisite Approvals, etc.
Approvals or permissions or licenses, etc. of the competent authorities, wherever required will be obtained by the RRB and it shall comply with all applicable laws, Rules and Regulations, etc.
Life Span of Dwelling Units
Since repayment period should not exceed the life span of the house / unit financed out of the housing loan, it should be ensured that the construction is pucca / semi-pucca with a life span of not less than 30 years.
Post-disbursal Discipline
There should be proper post-disbursement supervision and follow-up of housing loans to ensure proper end-use of funds as also timely and regular repayment of the loans.
Refinance at Discretion of NHB
Refinance in terms of this scheme shall be available at the sole discretion of NHB and cannot be claimed as a matter of right.
Inspection
The books of accounts, registers, and all other relevant records of the RRB maintained in respect of housing loans refinanced as also the land /houses, etc. financed from the same may be inspected by or on behalf of NHB .
Recall of Refinance
NHB reserves the right to recall the refinance in the event of diversion of the relative funds for purposes other than housing or for suppression of any material information by the RRB or the happening of any such event, which may, in the opinion of NHB, endanger the repayment of refinance.
NHB's Right to Modify The Scheme
NHB may, at its sole discretion, modify the Scheme either in respect of all RRBs or in respect of any one or group of RRBs.
Adverse Balance Certificate and list of flagged loans
RRB's would be required to submit a certificate as March 31 st every year, duly signed by their Chief Executive Officer, confirming that the outstanding refinance from NHB does not exceed the total outstanding housing loans, in respect of which refinance has been availed (flagged loans).
- In the case of adverse balance arisi
- ng due to pre-closure of loans in normal operations of lending and accelerated repayments, the same may be repaid following the required procedure and on the advice of NHB. Such repayments due to adverse balance shall not attract any levy.

The housing loans granted to the constituents have been utilised by them for the purpose for which the loans have been granted.
No refinance/finance has been taken against these loans from NHB or any other institution and these loan accounts would remain unencumbered during the pendency of refinance.
The housing loans covered under NHB refinance are classified as Standard Assets as defined under RBI guidelines.
The loan disbursed in rural areas for which refinance is being sought under the Golden Jubilee Rural Housing Refinance Scheme has been properly classified and the location of the dwelling unit is as covered by the 1991 census.
Maximum size of individual housing loan for which refinance is being claimed does not exceed Rs.15 lakhs.
We will properly identify all loans for which financial assistance is obtained from NHB and maintain a list of all such loans. All information pertaining to such accounts will be kept readily available with us. Individual housing loans once flagged against NHB's refinance will never be changed without prior sanction of NHB as long as they are in the books of Banks and they will be distinctly identifiable. List of such book debts would be submitted to NHB on demand. Further, the branches will be having the list of NHB refinanced loans at their end for easy identification during inspection.
